Mr. Schick presented a rep o rt on th e "L ibrary Statistics of Colleges a n d U niversities, 1971, D ata for Individual Institutions,” w hich is to b e p rin te d in final form b y th e G PO in ab o u t tw o m onths. H e to uched on th e new ap proach b ein g taken for com piling statistical d ata and th e national lib rary d a ta system w hich is being developed, w ith fifty state agencies p articip at­ in g in dissem inating th e survey form. A core form w ill be u sed to collect sim ilar d a ta from all types of libraries an d an a d d ed o r supple­ m entary form developed for e a c h type. Mr. Schick also stated th a t th e new survey forms conform to th e statistical standards of U NESC O . H e indicated th a t h e h a d copies of his m otion available a n d asked if h e could dis­ trib u te them . Such distribution having been m ade, Mr. R eason in q u ire d if Mr. H olly w ished to m ake a m otion a t this time. M r. H olly th e n M O V E D : T he A C R L B oard recom m ends th e following action to A LA C ouncil: In view o f th e fa c t th a t P e te r D oiron has n ow ag reed to invoke th e MAI p rocedure and this action has b een inform ally accepted b y th e A LA E xecutive B oard, it is clear th a t th e case rem ains open. T his b e in g so, w e move: 1. T h a t ALA has a n obligation a n d should p ay P e te r D oiron a retroactive a n d continu­ ing salary until such tim e as th e MAI find­ ings h av e b een p resen ted a n d passed upon; and 2. T h a t no final action shall b e tak en on filling th e position o f ed ito r o f C H O IC E u n ­ til th e final determ ination o f this case. Mr. Stone s e c o n d e d and a discussion period followed. Miss A ckerm an asked for an explana­ tion, seeking to learn th e basis for Item 1 of th e m otion reg ard in g th e continuance o f salary. Mr. H olly replied th a t th e m a tte r rem ains an op en case a n d h e believed p recedence exists for con­ tin u in g th e salary of individuals involved in an appeal. Mr. S hank stated th a t h e d id n ’t think so, th a t ra th e r th e opposite w as true. H e said th a t usual p rocedure w as to w a it u n til a d eter­ m ination of th e facts w as m ade, w ith retro ac­ tive p ay m en t to th e in dividual if it is fo u n d he h a d b een w ronged. Mr. Holly, how ever, said th a t academ ic institutions follow ed a different practice. Miss A ckerm an said th a t she was n o t very fam iliar w ith all th e facts o f th e case and was, therefore, n o t sure w h eth er th e ap p eal is based u p o n th e separation or if it is an appeal against certain procedures. I f it w as th e form er, th en she fe lt th a t to continue th e salary p ay ­ m ents w ould rem ove th e grounds fo r th e a p ­ peal. Mr. H olly interjected th a t d u rin g th e C H O IC E E d ito rial B oard m eeting th e question cam e u p w h eth er a replacem ent of th e ed ito r could b e an n ounced as long as SCMAI h a d th e case u n d e r consideration. H e th o u g h t th a t this recom m endation by th e A CR L B oard w ould ac­ celerate action by SCMAI. Mr. Shank inquired w h eth er th e appeal asked th a t Mr. D oiron be rein stated or if i t involved th e p rocedure used in dismissing him . Mr. R eason said th a t h e th o u g h t th e ap p eal h a d to do w ith th e proce­ dure. Mr. T anis w an ted to know if th e B oard h a d jurisdiction in th e m a tte r o r if th e y w ere only giving advice. Mr. Reason responded th a t th e Executive D irector of ALA h a d responsibil­ ity for all association employees. Mr. Johnson spoke next; h e in d icated th a t h e k new little of th e b ackground reg ard in g th e firing an d w an ted to learn if it w as u su al ALA procedure to have SCM AI involved in such cases. H e m entioned a m a tte r at his ow n u n i­ versity th a t w as b ro u g h t to SCMAI. H e w ished to know if action w as tak en in accordance w ith d u e process in th e D oiron case regardless of w h eth er th e dismissal w as justified. H e asked fo r m ore inform ation on this an d if such proce­ d u re w as n o t followed, h e w a n te d to know why. Mrs. R u th F ram e, vice-chairm an of th e ALA Staff C om m ittee on M ediation, A rbitration a n d In q u iry (S C M A I), announced today, T uesday, Jan u ary 18, 1972, th e re c e ip t of a form al “R equest for A ction” from P eter D.oi­ ron. Mr. D oiron, a form er A m erican L ibrary Association em ployee, was dism issed on July 29, 1971, as ed ito r o f C H O IC E ‚ th e Associa­ tio n of College an d R esearch L ibraries book- review ing journal. H is appeal fo r a hearing to b e conducted b y th e ALA Executive B oard w as denied d u rin g th e F all M eeting of th e B oard, w hen it was announced th a t th ey considered th e case closed b ecause Mr. D oiron h a d refused to u se adm inistrative pro­ cedures available to him . A form al “R equest fo r A ction” was received b y th e C om m ittee on Jan u ary 17, 1972, and Mrs. F ram e, as vice-chairm an, called a m e e t­ in g of SCMAI. J. Clift, exec­ utive director of ALA, as principals in th e dismissal of Mr. D oiron, w ill n o t sit on SCM AI d u rin g th e inquiry. Mrs. F ram e announced th a t th e C om m ittee h a d ac c e p te d th e req u est an d w ill appoint a fact-finding team . 2. R ecom m ended S tatem en t to C ouncil from th e Presiding Officer. T he ch air w ould like to tak e a m om ent to re mind 75 C ouncil th a t it a d o p ted a mechanism for conducting inquiries an d investigations w hen i t a d o p ted th e Program o f A ction for M ediation, A rbitration and In q u iry in June, 1971. As a consequence, motions being b ro u g h t to th e floor of Council calling for in ­ quiry a n d /o r investigation relating to tenure, status, fair em ploym ent practices, due proc­ ess, ethical practices an d th e principles of in ­ tellectual freedom w ill b e ru led o u t o f order. W e w ould like to advise m em bership and C ouncil, a t this tim e, th a t requests b y in d i­ viduals o r institutions fo r inquiries in these areas should go directly to th e Staff Com­ m ittee on M ediation, A rbitration and In ­ quiry. T his statem ent was m ad e b y Mr. D om s d u r­ ing the Sunday m eeting of th e C om m ittee for Policy Im plem entation of th e Staff C om m ittee on M ediation, A rbitration a n d In q u iry and will b e re a d before C ouncil on Tuesday, Jan u ary 25. Mr. R eason continued by saying th a t he h a d in ­ ten d ed to read these statem ents in response to Mr. H olly’s letter. H e also ind icated th a t he th o u g h t i t possible som eone from th e Board m ig h t b e asked to sit o n an investigating com­ m ittee an d th a t therefore h e th o u g h t no dis­ cussion was proper. Mr. Shank asked if perhaps Mr. H olly should d irect his m otion elsew here. Mr. H olly strongly objected; h e reiterated th a t in his opinion it was a responsible m otion and should go to C ouncil as an A CR L B oard recom m ended resolution. Several visitors th e n asked for recognition, th e first being Mr. K irkpatrick, w ho stated th a t as a dues-paying m em ber h e h a d th e rig h t to in ­ sist th a t th e P eter D oiron case b e h eard. M em­ bers, h e p o in ted out, pay th e salaries of th e staff, an d th e staff h a d b e tte r b e responsive to m em bership wishes. Mr. Reason answ ered, say­ in g th e case w ould b e h e a rd an d th a t h e h oped th e A CR L B oard m eeting could proceed w ith ­ ou t going into executive session. Mr. K irkpat­ rick in te rru p te d an d rep eated th a t th e m em bers w ere telling th e B oard w h a t to do an d th a t th e B oard h ad b e tte r do it. Mr. Reason asked if th ere was fu rth e r discus­ sion. Mr. Johnson rem arked th a t regardless of w h e th e r A L A /A C R L w ere rig h t or w rong, w e m u st hav e a h earin g in accordance w ith due process. Mr. Shank rep lied th a t th a t d id n o t seem to b e th e issue. Mr. B eard said th a t he really d id n o t feel th a t th e re was enough infor­ m ation a t this p o in t to vote on th e m atter. Mr. H offm an expressed th e sam e sentim ents and added th a t nothing as y e t h a d been bro u g h t u p w hich seem ed germ aine to th e m a tte r of retro ­ active pay. Several visitors again attem p ted to en ter into th e discussion and Mr. R eason adm onished th a t th e m em bers of th e B oard w ould b e h e a rd first. Mr. H o p p th e n asked if Mr. H olly w ould object to dividing th e m otion into tw o p arts an d then having a discussion separately on each part. Mr. Holly replied th a t he su p p o rted th e m otion as p resen ted and w ould vote against am ending it. Mr. Shank th e n b ro u g h t o u t th e fa c t th a t w e w ere m oving to pay Mr. D oiron an d n o t to a p ­ po in t a n ew ed ito r of C H O IC E , w h en b o th m atters are n o t w ithin th e B oard’s province. H e stated th a t th e B oard m ay recom m end action, b u t legally it w ould have no m eaning. Mr. H ol­ ly responded th a t h e th o u g h t it represented m em bership’s conviction th a t this was the just procedure to follow in th e case. T h e SCMAI investigation could drag on fo r some tim e. T h e A CR L B oard should presen t th e m otion to C ouncil an d le t C ouncil consider th e m atter from th a t standpoint. W e are discussing a rec­ om m endation h e said, and h e felt th a t Council w ould tak e action as requested, if th e m otion w as ap proved b y th e Board. M r. Reason asked if any o th er B oard m em ­ bers h ad com m ents to m ake. Miss A ckerm an said th a t th e re was one th in g w hich bo th ered h e r a b o u t Item 1: if th e re w as a fact-finding body app o in ted to investigate th e case and if th a t body fo u n d th a t th e action ta k e n w as justi­ fied, w h a t th en ? W o u ld Mr. D oiron b e asked to give b ack th e m oney h e received? She also felt th a t p a rt of th e m otion re la te d to th e find­ ing of facts an d could n o t b e passed b y th e B oard w ith o u t prejudicing th e fact-finding m is­ sion. Mr. H olly stated th a t th e case still being open, th e B oard ou g h t to consider continuing M r. D oiron’s p ay u n til th e issue is resolved. Miss A ckerm an th e n said th a t, in o th er w ords, w e are b ein g asked to recom m end action on h u ­ m anitarian grounds so th a t Mr. D oiron w ould n ot suffer h ard sh ip w hile th e m a tte r w as being considered b y SCMAI. M r. H olly agreed. Mr. Reason asked for fu rth e r com m ents from th e m em bers o f th e B oard. T h ere being none at th e m om ent, h e in q u ired to w h at ex ten t th e B oard w as w illing to h ear m em bers of th e a u d i­ ence. I t was generally agreed th a t th e floor should be o pened to th e au d ien ce fo r a period o f tim e n o t to exceed fifteen m inutes. Mr. W eb er first posed th e question w h e th e r any in ­ form ation w as available concerning th e tim e in ­ volved in th e SCM AI action, a n d M r. Reason replied in th e negative. Mr. D oiron th e n took th e floor a n d stated th a t as fa r as h e w as con­ cerned th e application to M AI w as still p en d ­ ing, as h e h a d n o t received th e com plete p e r­ sonnel file w hich h e h a d re q u e s te d an d w hich h e was supposed to b e furnished. Mr. Josey spoke next, saying th a t as a m em ber o f ACRL a n d th e person w ho circulated a petitio n on b e ­ h alf of Mr. D oiron, h e strongly u rg ed the ad o p ­ tio n of th e m otion. H e a d d e d th a t h e w as g reat­ ly d istu rb ed b y th e entire m a tte r an d th a t th e struggle fo r intellectual freedom a n d faculty status w ould b e m ade a m ockery if th e m otion w ere n o t adopted. Miss Hoduski stated th a t she h a d been involved in several such cases an d th a t salary w as usually contin­ ued u n til th e en d of th e contract or academ ic year. Mr. Reason in d icated th a t some clarification ap p e a re d necessary a t this point. Mr. D oiron h ad , indeed, received severance pay and ad d i­ tional com pensation for vacation. A lthough he did n o t feel th e am o u n t should b e m entioned, h e nevertheless w an ted to m ake clear th a t Mr. D oiron h a d n o t b e e n w ith o u t p a y since August. H e also m entioned th a t th e A LA E xecutive B oard h a d studied th e m a tte r an d considered th e case closed. Mr. G orm ley asked if th e ACRL Executive C om m ittee h a d b een bypassed in th e D oiron dismissal, and Mr. Reason replied th a t this was difficult to answ er as th ere w ere m any ram ifica­ tions to th e case. Mr. Shank p o in ted out th a t Mr. D oiron w as dism issed o n July 29, 1971, and asked w hy th e case was just now being considered an d w h y SCM AI h a d n o t b een called u p o n earlier. H e suggested th ere w ere other reasons fo r Mr. D oiron’s delay in taking his grievance to SCMAI an d th a t perhaps th e B oard m ig h t have to go into executive session to discuss all th e details. H e said th a t th ere w ere m an y delays being introduced into th e case an d th a t salary m ig h t b e continued for some tim e before adjudication. Mr. H olly ob­ jected th a t h ere w e w ere again g etting into th e province of SCMAI. Mr. Tanis w an ted to know if th e decision h a d been ap p ealed earlier, to w hich Mr. R ea­ son replied th a t th e answ er w ould d ep en d on w ho w as giving it—some w ould say yes and som e w ould say no. Mr. Tanis th e n in q u ired if du e process w as observed. Mr. R eason respond­ e d th a t this w ill b e d eterm ined by th e SCMAI, since th e basis of th e com plaint to th e com m it­ te e w as th a t d u e process h a d n o t been ob­ served. Mr. H op p stated th a t th e B oard should b e g reatly concerned th a t d u e process h a d b een follow ed; if SCM AI w as investigating, th en this p articu lar action w as n o t necessary. Mr. H olly answ ered th a t he understood there was no form al grievance procedure a t th e tim e of th e dismissal and th a t h e th o u g h t it w ould have b een ridiculous to appeal to SCM AI earlier, since b o th Mr. C lift an d Mr. T hom as sit on th a t com m ittee. Now, how ever, th e taking of this ro u te m akes sense since Mrs. F ram e has in d i­ cate d th e com m ittee w ould sit w ith o u t these tw o gentlem en. Mrs. E ubanks th e n rem arked th a t she h a d gone to th e ALA Personnel Office la s t A ugust an d asked for a copy of th e grievance proce­ dure; she w as told th a t th e re was no procedure an d w as fu rth e r advised th a t a n appeal to th e E xecutive B oard of ALA w as th e only w ay to g et th e case review ed. In h e r opinion, th e en o r­ mous m ishandling of th e case w as due to no process ra th e r th a n lack of d u e process. Mr. Em erick spoke next and said his confidence in ACRL was shaken an d th a t h e knew m any o ther m em bers felt th e sam e way. H e believed th a t a terrib le injustice h a d been done and th a t th e ACRL B oard h a d n o t provided for redress. H e could n o t state strongly enough th a t it w as high tim e th e B oard took action to alleviate th e suffering of Mr. D oiron an d his family. Mr. D oiron advised everyone th a t he h a d m ade an appeal to th e ALA Staff Association, know ing th a t th ere was no grievance p ro ce­ dure. H e w an ted to see w h a t th e Staff Associa­ tion could do. T w enty days later h e received a reply from Mrs. H alw ick inform ing him th a t th e Personnel A ppraisal C om m ittee w ould look into th e m atter. H e h a d to tu rn dow n this offer since Mrs. H alw ick w ould b e th e chairm an of th a t com m ittee. H e could n o t agree to this since Mrs. Halw ick w as directly involved in his dis­ missal. H e next tu rn e d to th e ALA E xecutive B oard for assistance b u t w as tu rn e d down. H e d id n o t receive any inquiries, nor w as h e of­ fered any help by SCMAI, h e said, u n til D e­ cem ber 17 w hen h e received a phone call from Mrs. F ram e asking if h e w an ted a conference w ith th re e m em bers of M A I and Mr. Doms. Mr. D oiron fu rth e r stated h e saw no reason to accept th is offer as h e w an ted a hearing, n o t a conference. H e therefore tu rn e d i t dow n. A fter Christm as h e received an o th er call an d was a d ­ vised th a t h e could appeal to SCMAI. H e th ereu p o n w as sent a R equest for A ction form. H e d id try to appeal, h e said, a n d h a d n o t rejected any offers to do so. Mr. T reyz identified him self as a form er chairm an of th e C H O IC E E d ito rial Board. H e felt th a t th ere h a d b een a g re a t deal of m isun­ derstanding b u t was sure justice w ould be done. Mr. H odgin said th a t Mr. D oiron w as d e­ nied d u e process an d th a t therefore th e B oard could not assume m alfeasance on his p a rt and could n o t deprive him of his incom e. H e re ­ ferred to th e incom petence of Messrs. Thom as an d C lift for n o t assuring th e existence of a grievance procedure for ALA staff. Mr. W eb er then asked if th e rep o rt of th e SCM AI w ould b e m ade public? W as th a t know n? Mr. Thom as replied th a t th e MAI reports go to th e ALA E x­ ecutive B oard w here decisions on ap p ro p riate action are m ade. T h e tw o officers agreed th a t ACRL could m ake such an assessment and th a t th e funds w ould b e reserved for use by th e division at its discretion, ju st as is th e case w ith funds of th e R ou n d Tables. H ow ­ ever, since our proposed assessm ent involves th e establishm ent of staff positions a t ALA h eadquarters, w ith a tte n d a n t ram ifications (e.g., space, equipm ent, fringe benefits, travel, e tc .) it w ould still b e necessary to p resen t o ur proposed b u d g e t for approval to C O PES, w ith th e u n derstanding th a t financing w ould come from A CRL special funds. Mr. M aclaren and Mr. G aertner agreed th a t th e special assessm ent for ACRL m em bers could b e collected along w ith th e regular ALA dues a t the en d of th e calendar year. T he com m ittee believes th a t if a poll of th e m em bers shows a m ajority to b e in favor of th e special assessm ent to establish th e office of Aca­ dem ic Status, th e following steps should b e ta k ­ en: ( 1 ) Special assessm ent should b e m ade along w ith dues collection a t th e en d of 1972; an d ( 2 ) W ith th e m oney (h o p efu lly ) in hand, a b u d g e t should be p rep ared for presentation to COPES for th e establishm ent of th e Office of A cadem ic Status. T his b u d g et, assum ing all costs are to b e borne b y A CR L, w ould b e cal­ culated to include various item s in addition to salaries as m entioned above. T h e com m ittee realizes th a t this procedure o f collecting th e m oney before presenting th e b u d g e t m ay seem irresponsible to some b u t w e can see no viable alternative. W e assume a m inim um rev en u e o f $55,000 a t $5.00 p e r capita from 11,000 m em bers. W e believe th a t this is m ore th a n sufficient to p ro ­ vide for th e first year’s operation of th e Office of A cadem ic Status. W e therefore recom m end th a t any balance of funds rem aining a t th e end of th e year b e h eld over to facilitate continued operation of th e Office. Finally, th e com m ittee recom m ends th a t even tho u g h w e m ay b e forced to m ake a spe­ cial assessm ent to establish th e Office of Aca­ dem ic Status, ACRL should continue its efforts to secure ALA funding for th e Office. T h e com m ittee w ould appreciate th e reaction of th e B oard of D irectors to th e follow ing spe­ cific questions: 1.
