[By Mr. Miles, Military Committee.] A BILL To change the mode ofjilliag Vacancies among Commissioned Officers of Companies, Battalions and Regiments. 1 Section 1. The Congress of the Confederate States of Ame- 2 rica do enact, That whenever a vacancy shall occur in the low- 3 est grade of conmiissioned officer in any company in the army, 4 the Captain of the company shall nominate the person to fill 5 the same, who, if approved by the Colonel of the regiment to 6 which the company belongs, and by the General commanding 7 the separate army or department in which the regiment is 8 serving, shall be forthwith assigned by the General to the va- 9 cant position, subject to the subsequent appointment by the 10 President, by and with the advice and consent of the Senate. 1 Sec. 2. Be it further enacted, That whenever atiy vacancy 2 above the lowest grade of commissioned officer, shall occur in a 3 company, the Lieutenant Colonel, Colonel or other (?bramanding 4 offic«'r of the battalion or regiment, shall nominate the person to 6 fill the same, who, if approved by the commander of the bri- 2 6 gade to which the battalion or regiment belongs, and by the 7 General commanding the separate army or department in which 8 the brigade is serving, shall be forthwith assigned by the General 9 to the vacant position, subject to the subsequent appointment 10 by the President, by and with the advice and consent of the 11 Senate. 1 Sec. 3. Be it further enacted, That whenever any vacancy 2 shall occur in the field officers of h battalion or regiment, the 3 brigade commander shall nominate the person to lill the vacan- 4 cy, who, if approved by the division commander, and by the 5 General commanding the separate army or department in which 6 the brigade is serving, shall be forthwith assigned by the General 7 to the vacant position, subject to the subsequent appointment S of the Presideat, by and with the advice and consent of the 9 Senate. 1 Sec. 4. Be it further enacted. That no person shall be nomi- 2 nated, assigned or appointed under the [jrovisions of thiji act, to 3 any commissioned office in a company, battalion or regiment, 4 who does not belong to the battalion or regiment.
