Ordered to be Printed Edwards & Broughton Printing Compaq. * r it 9 - Introduced by Senator C0Bb. - y i "£' 1 "•O* T ......- A BILL TO BE ENTITLED, “AN ACT TO PROVIDE • FOR THE ESTABLISHMENT AND MAINTENANCE OF COUNTY FARM-LIFE SCLIOOLS AND FOR TLIE PROMOTION OF AGRICULTURE AND HOME-MAK¬ ING.” The General Assembly of North Carolina do Enact: Section 1. There shall be established and maintained in 2 every county complying with the provisions of this act as 3 hereinafter set forth a school to be known as a “County 4 Farm-Life School” for the training and preparation of the 5 boys and girls of said county for farm life and home-making. Sec. 2. The aim of said school shall be to prepare boys 2 for agricultural pursuits and farm life and to prepare girls 3 for home-making and housekeeping on the farm. I he 4 course of study in said school shall be subject to the approval 5 of the State Superintendent of Public Instruction and an ad- 6 visorv board on farm-life schools, to be appointed by him. 2 Sec. 3. Said school shall be under the control and man- 2 agement of a board of trustees, consisting of one member 3 from each township in the county, appointed by the county 4 board of education, who shall serve until their successors 5 shall be appointed. The first board of trustees shall be di- 6 vided by the county board of education into three as nearly 7 equal groups as possime—one group shall be appointed for 8 a term of two years, one group for a term of four ' rr ears, and 9 one group for a term of six years. Upon the expiration of 10 the term of office of any trustee his successor shall be ap- 11 pointed for a term of six years. The county superintendent 12 of public instruction shall be ex-officio a member of said 13 board and secretary thereof. All vacancies occurring by 14 death, resignation or otherwise, in said board shall be filled 15 for the unexpired term by the county board of education. Sec. 4. Within ten days after any county, township or 2 townships shall have complied with the provisions of this 3 act as hereinafter set forth for the maintenance and equip- 4 ment of said school, the members of the board of trustees 5 shall be appointed, and the county superintendent shall duly 6 notify them to meet at the county seat within ten days after 7 their appointment, to qualify and organize. Sec. 5. After due advertisement, inviting bids for the StT? c/ 3 2 location o± said school within said county, said board of 3 trustees shall locate it at such place in said county as shall 4 offer the. largest financial aid for maintenance and equip- 5 ment, having due regard for desirability and suitability of 6 location: Provided, however, that said school shall not be 7 located in any city or town of more than one thousand in- 8 habitants, nor within three miles of the corporate limits of 9 any city or town of more than five thousand inhabitants. Sec. 6. For the maintenance of said school, the county 2 or township or school district, or all combined, wherein it 3 is located shall provide annually, by taxation or otherwise, 4 not less than twenty-five hundred dollars. The county or 5 township or school district, or all combined, shall also pro- 6 vide by bond issue, or otherwise, the following equipment 7 for said school: a school building with recitation rooms and 8 laboratories and apparatus necessary for efficient instruction 9 in the prescribed subjects of study; dormitory buildings 10 with suitable accommodations for not less than twenty-five 11 boys and twenty-five girls; a barn and dairy building with 12 necessary equipment; a farm of not less than twenty-five acres 13 of good arable land. All of said buildings shall be located on 14 said farm and shall be constructed in accordance with plans 15 approved by the State Superintendent of Public Instruction, 4 16 and the entire equipment shall be subject to his approval 17 and acceptance after inspection: Provided, however , that, 18 upon recommendation of the board of trustees and the pre- 19 sentation of satisfactory reasons therefor, the State Superin- 20 tendent, of Public Instruction may grant permission to said 21 board of trustees to accept any suitable and properly 22 equipped school building already constructed, though it may 23 not be located on said farm, provided it be located within 24 reasonable and convenient distance thereof, and may also 25 grant permission to reduce the required acreage for the 26 farm to not less than ten acres. Sec. 7. Upon written request of the county board of edu- 2 cation of any county, the board of county commissioners of 3 said county shall order an election to be held in said county, 4 in accordance with the law governing general elections there- 5 in, as nearly as may be: Provided, however, that a new reg- 6 istration shall be ordered for said election; and not less than 7 thirty days notice of said election shall be given at the 8 court-house door and three other public places in said / 9 county; and if there be newspapers published in said county, 10 a notice of said election shall also be published weekly for 11 four successive weeks preceding said election in one news- 12 paper therein; and the registrars and pollholders shall can- 5 13 vass the vote cast, declare the results, and duly certify the 14 returns to the board of county commissioners and the returns 15 shall be recorded in the records of said board of county com- 16 missioners. At said election shall be submitted to the quali- 17 fled voters of the county the question of levying and collect- 18 ing a special tax on all taxable property and polls of said 19 county for the maintenance and equipment of a “County 20 Farm-Life School” therein. At such election those favoring 21 the levying and collection of such a tax for said purpose 22 shall vote a ballot on which shall be written or printed the 23 words “For County Farm-Life School”; and those opposed 24 shall vote a ballot on which shall be written or printed the 25 words “Against County Farm-Life School.” If a majority 26 of the qualified voters shall vote “For County Farm-Life 27 School,” then all the provisions of this act shall be in full 28 force and effect, and the county commissioners shall annually 29 levy and cause to be collected, in the same manner and at 30 the same time as other taxes of the county are levied and 31 collected, a tax on all property and polls of the county suf- 32 ficient to provide the sum required of said county undei 33 Section 6 of this act for the annual maintenance of said 34 school, and, in addition, the sum required for the payment 35 of the annual interest on such bond issue as may be found 6 36 necessary for providing the equipment for said school re- 37 quired under Section 6 of this act as said interest accrues 38 and to create a sinking fund for the purpose of paying off 39 and discharging said bonds as they become due. The bond 40 of the sheriff or tax collector of said county shall be respon- 0 41 sible for said tax to the same extent as it is liable for other 42 taxes collected by him. V Sec. 8. If a majority of the qualified voters at the elec- 2 tion herein provided for shall vote “For County Farm-Life 3 School/ 7 it shall be deemed and held that a majority of the 4 qualified voters are in favor of granting to the board of 5 county commissioners of said county authority to issue bonds 6 in an amount not to exceed twenty-five thousand dollars for 7 the purpose of providing the necessary equipment prescribed 8 in Section 6 of this act; and such authority shall be granted 9 to and vested in said board of county commissioners and 10 said board is hereby authorized and empowered to issue and 11 sell bonds in the name of said county to an amount not to 12 exceed twenty-five thousand dollars, of such denomination 13 and of such proportion as said board of county commis- 14 sioners may deem advisable, bearing interest at a rate not to 15 exceed six per centum, with interest coupons attached, pay- 16 able at such time or times and at such place or places as 17 18 19 20 21 22 23 24 25 26 27 28 29 30 2 3 4 5 6 7 8 9 may be deemed advisable by said board of county commis¬ sioners, such bonds to be of such form and tenor and trans¬ ferable in .such way, and the principal thereof payable or redeemable at such time or times, not less than fifteen years from the date thereof, and at such place or places as said board of county commissioners may determine. The pro¬ ceeds arising from the sale of said bonds shall be expended by said board of county commissioners in providing, by pur¬ chase or otherwise, the equipment in land, buildings and apparatus required in Section 6 of this act for the “County Farm-Life School” : Provided, however, that the treasurer of said county shall receive no compensation for receiving or disbursing* the money which may be received from the sale of said bonds. Sec. 9. The county commissioners of any county that has voted for the establishment of ■ a “County Farm-Life School” therein shall, upon petition of one-fourth of the freeholders in any township applying to the trustees of said “County Farm-Life School to secure the location of said school therein, order an election therein, to be held after thirty days notice at three public places in said township, under the law governing State and county elections as nearlv as may be: Provided, that a new registration shall be ordered. 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 8 and the returns of said election shall be certified by the registrars and pollholders to the board of county commis- missioners, and the same shall be recorded in the records of said county commissioners; at which election shall be sub¬ mitted to the qualified voters of said township the question of issuing bonds in a sum not to exceed twenty-five thousand dollars, the amount of said bond issue to be set forth in the petition for said election, and of levying and collecting on all taxable property and polls in said township a special tax sufficient to provide for the payment of the interest on said township bonds as it accrues and to create a sinking fund for the purpose of paying off and discharging said township bonds as tliev become due. At such election, those favor- «y ing the levying and collection of such a tax for said purpose shall vote a ballot on which shall be written or printed the words “For County Farm-Life School,” and those opposed shall vote a ballot on which shall be written or printed the words “Against County Farm-Life School.” If a majority of the qualified voters at said election shall vote “For Coun¬ ty Farm-Life School,” then it shall be deemed and held that a majority of the qualified voters are in favor of grant¬ ing to the board of county commissioners of said county authority to issue bonds in the name of said township in 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 48 49 50 51 52 53 54 55 9 such amount as shall have been named in the petition and notice of election, to be sold by said commissioners for the purpose of aiding in providing the buildings and farm and other equipment for the “County Farm-Life School,” pro¬ vided said school shall be located in said township; and if said school shall be located in said township, the board of county commissioners shall annually levy and cause to be collected, in the same manner and at the same time as other taxes of the county are levied and collected, a tax on all property and polls in said township, sufficient to provide for the payment of interest on said township bonds ns it accrues and to create a sinking fund for the purpose of pay¬ ing off and discharging said township bonds as they become due; and said board of county commissioners is hereby au¬ thorized and empowered to issue and sell said bonds of said township to the amount specified in said petition and notice of election, of such denomination and of such proportion as said board of county commissioners may deem advisable, bearing interest at a rate not to exceed six per centum, with interest coupons attached, payable at the same time or times, and at the same place or places, and ol the same form and tenor, and the principal thereof payable or redeemable at the same time or times and at the same place oi places as tin 56 57 58 59 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 2 10 county bonds issued by said board of county commissioners for the equipment of said “County Farm-Life School.” The proceeds arising from the sale of said township bonds shall be added to the proceeds arising from the sale of said county bonds and expended therewith by said board of county com¬ missioners in providing, by purchase or otherwise, the equip¬ ment in land, buildings and apparatus required in this act for the “County Farm-Life School”: Provided, however, that any two or more contiguous townships bidding for the location of said “County Farm-Life School” may unite and hold an election upon the same terms and conditions as are herein provided for one township for the location of the “County Farm-Life School” at such point in said townships as may be determined by the board of trustees of said “County Farm-Life School”: Provided, that the amount of bonds authorized to be isued by one or more townships in order to secure the location of the “County Farm-Life School'’ in a given township shall be deducted from the amount of bonds authorized to be issued by the county, so as to limit the total issue of bonds for farm, buildings and equipment to twenty-five thousand dollars. Sec. 10. In case anv county fails to hold an election as herein provided for the establishment and maintenance of 11 3 a i County Farm-lute School therein, or in case such an 4 election shall be ordered and held in any county and a ma- 5 jority of the qualified voters at such election shall fail to 6 vote “For County Farm-Life School/’ any township in said 7 county, or any two or more contiguous townships in said 8 county, shall, upon petition of one-fourth of the freeholders 9 therein to the board of county commissioners of said county, 10 have an election ordered by said commissioners upon the 11 same terms and conditions prescribed in Section 9 of this 12 act; and if in such election a majority of the qualified voters 13 in said township or townships shall vote “For County Farm- 14 Life School,” then, in that event, it shall be deemed and 15 held that the board of county commissioners of said county is 16 authorized and empowered to issue and sell bonds in the 17 name of said township or townships in an amount not to 18 exceed twenty-five thousand dollars, and to levy and to cause 19 to be collected in the same manner and at the same time as 20 other taxes of the county are levied and collected, a suf- 21 ficient tax on all property and polls in said township or 22 townships to comply with all the conditions named in this 23 act for the maintenance and equipment of a “County Farm- 24 Life School,” subject to the same conditions as are herein 25 provided for the issuance and sale of couutv bonds and the 12 26 levying- and collection of a county tax for said purpose; and 27 the said “County Farm-Life School” shall thereupon be 28 located at such point in said township or townships as may 29 be determined by the board of trustees of said “County 30 Farm-Life School” provided for in this act; and such school, 31 when thus established shall he a “County Farm-Life School” 32 for said county, and shall he subject to all the rights, 33 privileges and obligations and conditions prescribed in this 34 act for “County Farm-Life Schools,” except as herein otlier- 35 wise provided: Provided, however, that in case of the estab- 36 lishment of said school in accordance with the provisions of 37 this section, the members of the board of trustees of said 38 school shall be residents of said township or townships, the - ' 39 number from each township to he determined by the county 40 county board of education, and free tuition in said school 41 shall he restricted to residents of said township or townships. Sec. 11. There shall be established in connection with 2 each “County Farm-Life School” a first-grade public high 3 school under the provisions of the public high school law of 4 the State. The hoard of trustees of the “County Farm-Life 5 School” shall constitute the high school committee and shall 6 be vested with all the powers conferred upon said eommit- 7 tee under the public high school law, and the principal of 13 8 the “County Farm-Life School” shall also be the principal 9 of the public high school. If said “County Farm-Life 10 School” shall not be located at the same place with and in 11 conjunction with some existing public high school in said 12 county, or if the State Board of Education can not make an 13 apportionment out of the State appropriation for high 14 schools for the establishment of an additional high school 15 for said county in conjunction with said “County Farm- 16 Life School,” then the county board of education of said 17 county shall remove one of the existing high schools in said 18 county to said “County Farm-Life School.” In the arrange- 19 ment of the courses of study for said high school and said 20 “County Farm-Life School,” the work shall be correlated 21 as closely as possible, so as to prevent duplication of classes 22 in the same studies. Sec. 12. Ho person shall be employed as principal in 2 charge of any “County Farm-Life School” who does not 3' hold a High School Teacher’s Certificate on all required sub- 4 jects except Latin, Greek and. modern languages, including 5 an additional certificate from the State Board of Examiners 6 and the President of the ISTorth Carolina College of Agri- 7 culture and Mechanic Arts, stating that he has furnished 8 satisfactory evidence to them of his qualifications by special 14 9 training and practical experience for said position. And 10 no person shall he employed in the department of said 11 “County Farm-Life School” for the special training of girls 12 for home-making and housekeeping on the farm who does 13 not hold a High School Teacher’s Certificate on all required 14 subjects except Latin, Greek and modern languages, includ- 15 ing an additional certificate from the State Board of Ex- 16 aminers and the President of the State Normal and Indus- 17 trial College, stating that such person has furnished to them 18 satisfactory evidence of qualifications by special training 19 and practical experience for said position. Sec. 13. It shall be a part of the duty of the faculty of 2 each “County Farm-Life School” to conduct agricultural 3 farm-life extension and demonstration work in said county, 4 in co-operation, as far as possible, with such work carried 5 on in said county by the State Department of Agriculture, 6 the North Carolina College of Agriculture and Mechanic 7 Arts, and the United States Department of Agriculture; to 8 hold township and district meetings in various parts of the 9 county from time to time for farmers and farmers’ wives; 10 to co-operate with the county superintendent of public in- 11 struction and with the county commissioner of agriculture, 12 where such officer exists, in stimulating, directing and super- 15 13 vising practical farm-life work in the public high schools 14 and the elementary schools of the county, and in providing- 15 instruction, through the County Teachers’ Association and 16 through special short courses of study at said “County 17 Farm-Life School,” for the public school teachers of said 18 county. There shall be provided in the courses of study 19 of said “County Farm-Life School” short courses in farm- 20 life studies to which shall be admitted adult farmers, men 21 and women; and there shall be held at said “County Farm- 22 Life School” annually one or more county meetings for the 23 farmers and their wives of said county for instruction and 24 demonstration work. All of the work herein required and 25 all other work of the “County Farm-Life School” shall be 26 under the general supervision of the county superintendent 27 of public instruction, and said school shall in all respects be 28 an organic part of the county public school system. Sec. 14. The hoard of trustees of the “County Farm-Life 2 School” of any county is hereby authorized and empowered 3 to admit students from other counties of the State to said 4 school upon payment of such rate of tuition as said board 5 of trustees may fix; but all students who are residents of 6 the county in which said school is located shall be admitted 7 to said school without charge for tuition, except as provided 16 8 for in Section 10 of this act.; and said board of trustees 9 shall fix all other charges in said school at actual cost. Sue. 15. The treasurer of said county shall be the treas- 2 urer of said “County Farm-Life School/- and shall receive 3 and disburse all funds therefor, keeping and rendering an- 4 nuallv to the board of trustees of said school a separate 5 account of such receipts and disbursements: Provided, that 6 said treasurer, if employed on salary, shall receive no addi- 7 tional compensation for his services; and if employed on 8 commission, he shall receive as compensation not to ex- 9 ceed one per cent on all disbursements and nothing on re- 10 ceipts. The official bond of said treasurer shall be respon- 11 sible and held liable for all funds coming into his hands for 12 said school to the same extent as it is liable for other funds 13 received by him as treasurer of said county. Sec. 16. The board of trustees of the said “County Farm- 2 Life School” and their successors in office shall be and are 3 hereby constituted a body corporate by the name and style 4 of “The Board of Trustees of the County Farm-Life School 5 of . County,” and by that name may sue and 6 be sued, contract and be contracted with, purchase, hold and 7 sell real estate and personal property, receive donations by 8 gift or otherwise, and exercise such other rights and priv- 17 9 ileges as are conferred by law upon corporate bodies. The 10 title to all lands and other property of the “County Farm- 11 Life School’ 1 shall vest in said board of trustees. Sec. 17. The sum of fifty thousand dollars is hereby an- 4/ «y 2 nually appropriated out of the State Treasury to aid in the 3 maintenance of “County Farm-Life Schools.” Upon satis- 4 factory evidence furnished to the State Board of Education 5 that any county has complied with all the provisions of this 6 act for the establishment, maintenance and equipment of a 7 “County Farm Life School,” the. State Board of Education 8 shall apportion to said county out of the said State appro- 9 priation the sum of twenty-five hundred dollars annually 10 for the maintenance of said school. The State Superin- 11 tendent of Public Instruction shall issue a requisition on the 12 State Auditor for the amount to be apportioned to any 13 county, who shall issue his warrant in favor of the county 14 treasurer of said county for said amount, and the money 15 shall be placed by said treasurer to the credit of the “County 16 Farm-Life School” of said county.
