SE Try $ 1991 TOXICS RELEASE INVENTORY "a PROT® ANON & INTRODUCTION The Toxics Release Inventory (TRI) is mandated by section 313 of the Emergency Planning and Community Right-to-Know Act (EPCRA) of 1986. The law is based on the premise that citizens have a right-to-know about chemicals in their communities. It has two main purposes: to provide planning for response to chemical accidents; and to provide the public and the government with information about possible chemical hazards. The purpose of this State Fact Sheet book is to provide a status of TRI data at the state level. Under section 313 of EPCRA, certain manufacturers must report on an annual basis the amounts of over 300 toxic chemicals, including those in 20 chemical categories, that they release directly to the air, water, or land, or that they inject underground. The reports also include information on amounts transferred to off-site locations for treatment or disposal. In 1991, for the first time, facilities also provided additional information mandated by the Pollution Prevention Act (PPA) of 1990, such as amounts recycled on- and off-site, amounts used for energy recovery on- and off-site, amounts treated on-site, and amounts released due to non-production related events (e.g., accidental spills). The reports are sent to the U.S. Environmental Protection Agency (EPA) and to the states or tribes. The law specifies that the EPA must compile these reports into an annual inventory that is publicly available by computer telecommunication and other means on a cost- reimbursable basis. STATE FACT SHEET INFORMATION The fact sheets provide, for each state, the following TRI information for 1991: 0 << =. pa = = “Q AON = 1. A map of each state is provided which contains a dot for every facility reporting to the TRI in 1991. C Ml x 2. For each state, data are provided on the amounts of materials released directly on facility sites to the air, water, and land, and amounts injected into underground wells (on-site releases). Due to the PPA, data is also presented for the first time for on- and off-site waste management activities including the amounts recycled on- and off-site, burned for energy recovery on- and off-site, oF Ss. Amounts are also presented for toxic chemicals transferred to publicly owned treatment works, and sent off- site for treatment and disposal. ("Other Off-site Transfers" refers to amounts reported with no off-site management code or an invalid code.) 3. Each state fact sheet includes the state’s population, total number of facilities reporting to TRI, the number of TRI forms submitted (more than one form per facility may be submitted), and the state’s national ranking based on the total amount of on- site releases to air, water, land, and chemicals injected underground. (The population statistics for states are from 1991 census updates; however, 1990 values are presented for American Samoa, Puerto Rico, and the Virgin Islands, as these are the most recent data available.) 4. The top 5 chemicals and the top 10 facilities in the state based on total on-site releases to air, water, land, and chemicals injected underground are presented. 5. A list of some of the TRI data user support services provided by the state is presented. 6. Contacts are provided for people interested in learning more about the TRI data (including how to access it and various uses). Status oF STATE TRI PROGRAMS The Federal government and the states share responsibility for managing the TRI data and making them available to the public. In the past two years, many of the states’ TRI programs have grown along with and, for some, beyond the Federal program, by covering more chemicals or industries, creating annual reports, conducting health or Geographic Information System (GIS) analyses, and having the annual TRI data available earlier. A number of groups have conducted surveys on the status of state TRI programs. The results of the two most recent surveys follow: €0 S74 Ra NZ; 1991 TOXICS RELEASE INVENTORY AN A prove’ NOH, 8 Ohio EPA Survey The Ohio EPA surveyed the states and the territories this winter and collected the following information (all states did not respond to all questions): » Employees - Twenty states have at least 1 full-time TRI employee, 30 have at least 1 part-time TRI employee, and 26 states have no full-time TRI employees. e Statutory Authority - Sixteen states have included statutory authority and 30 states have not. + Funding - Six states spend between $50,000 and $200,000 on the TRI program, 11 states spend $50,000 or less on the TRI program, and 29 states do not fund the TRI program. For more information on this survey, contact the EPCRA Information Hotline (800-535-0202). National Conference of State Legislatures (NCSL) Survey This survey’s results were released in June of 1992. The NCSL survey focused on the services states offered to their citizens. Overall, the states provide the public with a great variety of assistance in understanding, using, and accessing the TRI. State reports have been created by 22 states. Twenty-seven of the states use the EPA-created state TRI diskettes and/or CD-ROM. State TRI diskettes are available to the public on request in 19 states. Some states augment EPA’s own outreach efforts by distributing the TRI data to their Local Emergency Planning Committees or LEPCs (25) and libraries (7). Thirty-four states have entered some (26) or all (8) of the TRI data into their own computer systems, and four states plan to computerize the data. Twenty of the states responding said they will perform computer searches for the public. State-generated customized database reports for the public have been made available by 26 states. A lesser number of states are providing more specialized use of the TRI by providing the public with health effects and/or risk analysis data (17), and using the TRI for GIS/mapping analysis (7).
