An Act for fettling and fecuring a certain Annuity on Earl Wellington and the Two.next Perfons to whom the Title of Earl Wellington ihall defcend, in Confideration of his eminent Services. [20th April 1812.] Moil Gracious Sovereign, WHEREAS Your Majeily,by Your mod Gracious Mefiage to the Houfe of Commons, has been pleafed to declare that Your Majefty having taken into Your Royal Confideration the eminent and fignal Services performed by General Lord Vifcount Wellington in the Courfe of a long Series of diftinguilhed Exploits in the Campaigns in Spain and Portugal, and being defirous to mark the Senfe You entertain of Services fo honorable to the Britijh Arms, and fo eminently beneficial to the Interefts of the Nation, have conferred upon General Lord Vifcount Wellington and the Heirs Male of his Body the Rank and Dignity of an Earl of the United Kingdom, by the Name, Stile, and Title of Earl Wellington ; and Your Majefty being further defirous of granting to the Earl of Wellington a Net Annuity of Two thoufand Pounds, in Addition to the Annuity already granted by Parliament, and fubjeft to the fame Limitations impofed in that Grant, recommended it to your faithful Commons to enable His Majefty to grant and fettle fuch Annuity, and to make fuch further Provifion as aforefaid, as may be thought molt effedual for the Benefit of General the Earl of Wellington and his Family ; We, Your Majefty’s molt dutiful and loyal Subjects, the Commons of Great Britain and Ireland, in Parliament aflembled, duly confidering Your Majefty’s molt gracious Intention, do molt humbly befeech Your Majefty that it may be enaded ; and be it enaded by the King’s molt Excellent Majefty, 4 H 9 by3©6 An Annuity of 2,oool. gtanted in Addition to that under 50G.3.C.8. Cap.37. by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament aflembled, and by the Authority of the fame, That in Addition to the Annuity already granted to the faid Earl, then Vifcount Wellington, by an Aft palled in the EiftiethYear of the Reign of His prefent Majeily, intituled An Ailforfettling and fecuring a certain Annuity on Vifcount Wellington, and the Two next Perfons on whom the Title of Vifcount Wellington jhall defeend, in Confideration of his eminent Services, one other Annuity or yearly Rent or Sum of Two thoufand Pounds of lawful Money of Great Britain, ihall be bluing and payable out of and c-harged and chargeable upon the Confolidated Fund of Great Britain, (after paying or referving fufficient to pay all fuch Sum and Sums of Money as have been diretted by any former Aft or Afts of Parliament to be paid out of the fame), but with Preference to all other Payments which (hall or may hereafter be charged upon or payable out of the faid Fund, and the fame ihall from Time to Time be paid Quarterly, free and dear of all Taxes and Deductions whatfoever, in Manner and Form following ; that is to fay, to the faid Earl Wellington, for and during the natural Life of the faid Earl Wellington, and from and after his Deceafe, unto the Two next fucceeding Heirs Male of the Body of the faid Earl Wellington, on whom the Title, Honour, and Dignity of Earl Wellington ihall defeend, for and during their natural Lives ; which faid Annuity or yearly Rent or Sum ihall commence and take Effeft from the Fifth Day of January One thoufand eight hundred and twelve ; the Firft Payment to be computed from the faid Fifth Day of January One thoufand eight hundred and twelve, until the Fifth Day of April One thoufand eight hundred and twelve.; and from thenceforth fhall be paid and payable at the Four ufual Days of Payment in the faid Year, (that is to fay,) the Fifth Day of July, the Tenth Day of Oilober, the Fifth Day of January, and the Fifth Day ■of April, in each and every Year, by even and equal Portions. Debentures to be made forth at the Exchequer for the Payment. II. And it is hereby further enafted, That it ihall and may be lawful to and for the Commiflioners of His Majeily’s Treafury now being, and the High Treafurer and Under Treafurer of the Exchequer, and Commiflioners of the Treafury for the Time being, and they are hereby authorized and required by Warrant under their Hands, to direft the Auditor of the Receipt of the Exchequer now and for the Time being, to make forth and pals Debentures from Time to Time for paying the faid Annuity or yearly Rent or Sum of Two thoufand Pounds, in Manner as aforefaid ; and as the fame ihall from Time to Time become due and payable, without any Fees or Charges to be demanded -or taken for paying the fame or any Part thereof; which faid Warrant and the Debentures to be made forth and pailed thereupon ihall be a fufficient Authority to the feveral ;and refpeftive Officers of the Receipt of the Exchequer, now and for the Time being, for the Payment of the faid Annuity or yearly Rent or Sum to the laid Earl Wellington, and the 1 wo next iucceeding Heirs Male of the Body of the laid Earl Wellington, at the refpeftive Quarterly Feaft Days in this Aft before appointed for Payment thereof, without any further or other Warrant to be i'ued for, had, or obtained in that Behalf. Annuity not HI- And it is hereby further enafted, That after figning of fuch -determinable. Warrant the fame ihall be good, valid, and efleftual in Law, according to the Purport, and true Meaning thereof and of this Aft, and ihall not be determinable or recoverable by or upon the Demils of His Majefty (whomstl( Ci.o'i Ó *Lf 52°GEORG II III. Cap.37. 307 God long preferve) or of any of His Heirs or Succeffors, or by or upon the Death or Removal of any of the faid Commiffioners of the T reafury or the Lord High Treafurer, or by or upon the Determination of the Power, Office or Offices of them or any of them. IV And be it further enaded, That the Commiffioners of the Treafury No F« to be now being, and the High Treafurer of the Treafury for the Time being, takcn-Chancellor and Under Treafurer, Chamberlain andBaronsof theExchequer, and all other the Officers and Minifters of the Court of Exchequer, and of the Receipt thereof now and for the Time being, lhall and they are hereby authorized and ftridly enjoined and required to do, without Fee or Reward all fuch Afts, Matters, and Things as are herein-before direded and required, or lhall be neceffary to be done and performed by them or any or either of them, in order to tender this Aft and the feveral Payments hereby direfted effectual. V And be it further enafted, That the Acquittance or Acquittances, Receipt or Receipts of the faid Earl Wellington, and the Two next fucceed-inE Heirs Male of the Body of the faid Earl Wellington on whom the faid Title lhall defeend, lhall be a good and fufficient Difcharge for the 1 ayment of the faid Annuity or yearly Sum without any further or other Warrant to be fued for or obtained in that Behalf; and that the faid Annuity or yearly Rent or Sum, and every Part thereof, lhall be free and clear from all Taxes, Impofitions, and other Charges whatfoever ; and in cafe any of the Officers of the Receipt of His Majeity’s Exchequer lhall refule or neglect to pay the faid Annuity or yearly Rent or Sum, or any Part thereof, according to the true Intent and Meaning of this Aft, or to do any Act neceffary to enable the faid Earl Wellington and the Two next fucceedmg Heirs Male of the Body of the faid Earl Wellington on^whom the faid 't itle, Honour, and Dignity of Earl Wellington lhall defeend, to receive the fame, then the faid Earl Wellington, and the I wo next fucceedmg Heirs Male of the Body of the faid Earl Wellington on whom the faid Title (hall defeend, may from Time to lime ffie, profecute, and implead fuch Officers or any of them, their Heirs, Executors, or Ad-miniftrators, by Bill, Plaint, or Aftion of Debt, and fall and may recover Judgement and fue out Executions thereupon againlt fuch Officer refoeftively; their Heirs, Executors, or Adminiftrators, for to much of fuch Sum or Sums of Money then due and owing upon the faid Annuity, yearly Rent or Sum, or any Part thereof, as (hall have been m the Hands of the Officer or Officers of the Receipt of the Exchequer at the l™e or l imes when Demands lhall have been legally made of the Payment of theTa Annuity, yearly Rent, or Sum, or any Part thereof as aforefaid, or for the RefufaiorNeglea to do any Aa neceffary to be done by luch Officer 1 Officers refpeaively.
